By utilizing any part of the Yariex Platform, you're agreeing to our Terms of Use. We encourage you to review these terms carefully to ensure complete understanding and agreement before engaging with our services. If you do not accept these terms, please refrain from using the Yariex Platform.

User Obligations

You agree to use the Yariex Platform in compliance with applicable laws, regulations, and these Terms of Use. You shall not engage in any unauthorized or unlawful activities, including but not limited to unauthorized access, data mining, or any activity that disrupts the integrity or security of the Yariex Platform.

Ownership and Intellectual Property

All rights, title, and interest in and to the Yariex Platform, including any intellectual property rights, are and will remain the exclusive property of Yariex. You acknowledge that you do not acquire any ownership or other rights in the Yariex Platform except for the limited right to use the services outlined in this Agreement.

Privacy and Data Protection

Yariex respects your privacy and handles your personal information in accordance with its Privacy Policy. By using the Yariex Platform, you consent to collecting, using, and disclosing your personal information as described in the Privacy Policy.

Engagement of Third-Party Service Providers

Yariex engages trusted third-party service providers, including financial institutions, banks, and Visa, to facilitate certain Yariex Services, including cardholder identity verification. By using the Yariex platform, you acknowledge and agree to Yariex's reliance on these third-party service providers for the specific purpose of cardholder identity verification. However, Yariex retains full responsibility for the overall functioning, security, maintenance, and support of the platform and its content. You further acknowledge that these service providers and their affiliates are recognized as third-party beneficiaries of the Terms and Conditions. Upon accepting the Terms and Conditions, the service providers hold the right to enforce them against you as third-party beneficiaries for the services they provide.

Limitation of Liability

In no event shall Yariex be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Yariex Platform. Yariex's total liability, if any, arising from this Agreement shall not exceed the fees paid by you for the specific services giving rise to the liability.

Termination

Yariex reserves the right to terminate or suspend your access to the Yariex Platform at any time and for any reason without prior notice. You may also terminate this Agreement by discontinuing the use of the Yariex Platform.

Amendments

Yariex reserves the right to modify or update these Terms of Use at any time. Any changes will be effective immediately upon posting the updated terms on the Yariex website or through the Yariex Platform. Your continued use of the Yariex Platform after any modifications constitutes your acceptance of the updated terms.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the province of Ontario, Canada. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in the province of Ontario.

Entire Agreement

This Agreement constitutes the entire Agreement between you and Yariex regarding the use of the Yariex Platform and supersedes any prior agreements or understandings, whether oral or written, relating to the subject matter herein.

Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

The failure of Yariex to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if it is in writing and signed by an authorized representative of Yariex.

Assignment

You may not assign or transfer this Agreement, in whole or in part, without the prior written consent of Yariex. Yariex may freely assign or transfer this Agreement without restriction. Any attempted assignment or transfer in violation of this provision shall be null and void.
